Terms Of Service
Please read the Terms Of Service before using our services, last update: 03/01/2024.
1.2 DigiVeste only supplies products to customers who have agreed to the terms and conditions.
1.3 Dutch law applies to these terms and conditions.
1.4 DigiVeste is authorized to change the terms and conditions at any time without notice.
1.5 The agreement starts when the confirmation email of the order is sent.
1.6 If a part of the agreement is not legally valid, this does not affect the validity of the rest of the agreement.
1.7 DigiVeste expects the customer to provide all truthful information on registration; payment information should be accurate and belong to the registering individual, unless it pertains to someone under the customer's custody or guardianship.
1.8 DigiVeste will never send any marketing-related emails without an unsubscribe button. Marketing emails will only be sent with prior permission from the customer; unsolicited messages will not be sent.
2.1 DigiVeste aims to deliver the product within 24 hours, unless stated otherwise in the product description.
2.2 DigiVeste delivers products only if the corresponding invoice is marked as paid.
2.3 DigiVeste guarantees that the product meets the specifications and conditions stated in the offer.
3.1 We use the payment term indicated on the invoice unless agreed otherwise.
3.2 Services might not be activated automatically after payment verification.
3.3 The purchased service is automatically suspended when this service is overdue.
3.4 The right of withdrawal begins upon activation of the service and lasts for 14 days.
3.5 The right of withdrawal is only legally valid if the procedure takes place via means of communication stated in Article 10 paragraph 1 with the exception of means of communication 2, 3, and 5.
3.6 The right of withdrawal is only legally valid if the procedure is via DigiVeste and not through third parties.
3.7 The right of withdrawal is not valid on custom spec to-order services, such as but not limited to custom dedicated servers and custom VPS products.
3.8 The right of withdrawal is not valid for business customers.
4.1 Images, illustrations, texts, video(fragments), etc. on all platforms of DigiVeste are only indicative and cannot be used as a result of a termination of an agreement or return of payment.
4.2 Copyright applies to all images, illustrations, texts, video (fragments), and other visual aspects.
5.1 DigiVeste is not liable for damages resulting from service interruptions or maintenance.
5.2 The maximum liability will never exceed the value of the service.
6.1 Force majeure means errors of suppliers of DigiVeste, interruptions, malfunctions, (terrorist) attacks, fire, water damage, internal problems, licensing problems, DDoS attacks, and problems in the business operations of third parties.
6.2 If the force majeure situation lasts longer than 30 days and after 30 days still affects the service, both parties are entitled to terminate the agreement. Reimbursement does not apply in any situation.
7.1 The servers of DigiVeste are located in various data centers such as but not limited to: Digital Realty AMS05 Amsterdam, Evocative EWR1 New York, and Nikhef Housing Amsterdam.
7.2 DigiVeste performs irregular backups and is not obligated to provide regular backups or restore data.
7.3 Maintenance work may occur without prior notice, and interruptions due to maintenance is not considered downtime unless agreed upon in our SLA.
7.4 At the time of excessive use of a service, DigiVeste is authorized to suspend the service or charge an additional invoice for the costs incurred.
8.1 All prices indicated on the internet site or communication platforms of DigiVeste are only indicative and subject to printing, typesetting, and spelling errors. The indicated price does not affect the validity of the agreement.
8.2 When DigiVeste adjusts the prices of a product or service, this will be applied to the next invoice.
8.3 All prices on the internet site of DigiVeste exclude VAT for people outside The Netherlands.
8.4 All prices on the internet site of DigiVeste are in Euro.
8.5 DigiVeste is authorized to adjust prices if communicated to the customer at least 14 days in advance.
9.1 It is prohibited to use DigiVeste's services for activities that contravene Dutch law, such as but not limited to DDoS attacks, spreading defamatory messages, racism, hate speech.
9.2 Should DigiVeste determine that there is a potential for disruption, harm, or any other threat to the integrity of our services, the functioning of our computer systems or network, or that of third parties, especially due to activities such as hacking, denial of service attacks, exploitation of bugs, or vulnerabilities in the software of DigiVeste or that of third parties, DigiVeste reserves the right to implement any reasonable measures deemed necessary to mitigate or prevent such risks.
9.3 DigiVeste may recover damages from violations of these Terms of Use. You indemnify DigiVeste of all third-party claims related to damage resulting from a violation of these Terms of Use.

11.1 “Customer" refers to the purchasing party, the person or legal entity who purchases a service from DigiVeste
11.2 "DigiVeste" is defined as the business entity registered under the trade name "DigiVeste" with Chamber of Commerce number 82651329, located at Tuinstraat 1, 7701GX, Dedemsvaart, The Netherlands.
11.3 “Personnel” means everyone who is employed or hired by DigiVeste
11.4 "Management" refers to the individuals holding positions within the C-Suite of DigiVeste
